Your question should be worded differently then. No, the word wasn't invented by marvel, but when used in the context of "THE punisher," then that's when you get into trademark issues. Using words aren't bad, but using words that others have claimed use of, is. Like, I can't make an app called batman because it's intellectual property. I can make one called dark bat because those (I don't think) are owned by someone else.

+John Hunter You'd be amazed at how you get get flagged… For instance… I made a release called "Doctor Who" and it was no go.. Althought these words when separated are ok… Together you cannot use them. Did you know? This is the reason for my questioning.
